3. Intellectual Property Rights

Unless otherwise agreed upon in writing (e.g., in a signed MSA), Durga Tech Solutions retains all rights, title, and interest in our proprietary software, tools, methodologies, and pre-existing intellectual property used in delivering our services. Custom deliverables specifically created for the client will be transferred to the client upon full receipt of payment, subject to the terms of the specific project agreement.

4. Client Responsibilities

To ensure successful project delivery, clients agree to:

  • Provide necessary access to systems, APIs, or accounts (including Zoho environments) required for development and integration.
  • Provide timely feedback and approvals during the development lifecycle.
  • Ensure that any materials provided to us (logos, copy, data) do not infringe on the intellectual property rights of third parties.

5. Confidentiality

Both parties agree to hold any proprietary or sensitive business information in strict confidence and use it solely for the purpose of executing the agreed-upon services. This obligation survives the termination of any agreement.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Durga Tech Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of our services or website.

7. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify users of any significant changes by updating the "Last updated" date at the top of this page.
